Terms of Use

1. Overview

Noir. ("the App") is a personal learning companion that lets you build custom curriculums, track your progress, and develop consistent study habits. The App is provided by Antoine Gosset ("we", "us", "our").

2. Eligibility

You must be at least 13 years old to use Noir. If you are under 18, you confirm that you have your parent or legal guardian's consent to use the App and agree to these Terms.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to bypass any security or access control features

4. Subscriptions & Payments

4.1 Noir. Pro

Noir. offers a premium subscription ("Noir. Pro") that unlocks additional features including accent color customization, font choices, rest days, advanced notification settings, and more.

4.2 Pricing & Billing

• Noir. Pro is available as a monthly or yearly auto-renewable subscription
• Prices are displayed in the App before purchase and may vary by region
• Payment is charged to your Apple ID account at confirmation of purchase

4.3 Auto-Renewal

• Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price
• Price changes will be notified in advance; continued use after a price change constitutes acceptance

4.4 Managing & Cancelling

You can manage or cancel your subscription at any time through your Apple ID account settings: Settings → Your Name → Subscriptions → Noir.

Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until then. No refunds are provided for partial billing periods.

4.5 Free Trial

If a free trial is offered, any unused portion will be forfeited when you purchase a subscription. Eligibility for a free trial is determined by Apple and limited to one per Apple ID.

5. User Content & Data

5.1 Your Data

All curriculums, learning resources, notes, and progress data you create in Noir. are stored locally on your device. You retain full ownership of your content.

5.2 Data Loss

Because data is stored locally, we cannot recover your data if you delete the App, lose your device, or perform a factory reset. We strongly recommend using iCloud Backup to protect your data.

5.3 External Links

The App may contain links to third-party websites or resources you add to your curriculums. We are not responsible for the content, accuracy, or practices of any third-party sites.

6. Intellectual Property

The App, including its design, code, graphics, icons, and branding, is owned by Antoine Gosset and protected by applicable intellectual property laws. The Noir. name and logo are our trademarks.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, uninterrupted, or free from harmful components.

Noir. is a productivity tool. We make no guarantees regarding learning outcomes, academic performance, or the accuracy of any third-party content you add to your curriculums.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the App.

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination, your license to use the App is revoked. Sections that by their nature should survive termination will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the revised Terms on this page
• Updating the "Last updated" date
• Providing notice within the App for significant changes

Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of France, without regard to its conflict of law principles. Any disputes shall be resolved in the competent courts of France.

13. Apple-Specific Terms

These Terms are between you and Antoine Gosset, not with Apple Inc. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation. Apple is not responsible for addressing any claims relating to the App.
